These terms govern the use of Uganda Safaris. They apply to everyone who uses the site: travellers who browse listings and send enquiries, and tour operators who register accounts and publish safaris. By using the site you accept them. If you do not accept them, do not use the site.

1. Who these terms are with
This site is operated by [TO BE COMPLETED: the full legal name of the business or individual operating the site, its legal form, its registered address, and its company or business registration number, if any], referred to below as “we”, “us”, “the site” and “Uganda Safaris”.
In these terms, an Operator means an independent tour company that holds an account on the site and publishes listings on it. A Traveller means anyone who uses the site to find, compare or enquire about a safari. Listing means a safari, itinerary, price, photograph, description or company profile published on the site by an Operator.
2. What this site is, and what it is not
Uganda Safaris is a listings platform. It exists so that safaris sold by independent Ugandan tour companies can be found and compared in one place. That is the whole of its function.
To state the consequences plainly:
- We are not a tour operator. We do not organise, arrange, package, operate, lead, guide or run any trip listed on this site.
- We are not the seller. We do not sell any safari, tour, transport, accommodation, permit, activity or any other travel service.
- We are not an agent. We do not act as the agent, broker, representative or intermediary of any Operator, of any Traveller, or of any supplier used by an Operator. We have no authority to make or accept any commitment on behalf of anyone.
- We are not an organiser or a retailer of package travel, and we do not assemble, combine or resell travel services.
- We take no bookings and handle no money. There is no booking function, no checkout, no deposit, no payment processing and no escrow on this site. We never receive, hold or handle a Traveller’s money.
- We charge Travellers nothing. Using the site, comparing listings and sending an enquiry are free.
No contract of any kind — of carriage, of travel, of tour, or of the supply of any service — arises between you and us. These terms are the only agreement between us, and they are an agreement about using a website.
3. Any trip you take is a contract with the Operator, not with us
When you enquire about a safari, your enquiry goes to the Operator that published it. Everything after that — the quote, the negotiation, the itinerary, the terms, the deposit, the payment, the booking, the cancellation policy, the insurance, the permits and the trip itself — happens directly between you and that Operator.
Any contract for a safari is formed solely between the Traveller and the Operator. We are not a party to it, we are not bound by it, we do not guarantee it, and we have no obligation or liability under it. We are not responsible for the Operator’s performance of it, or for their failure to perform it.
Read the Operator’s own terms and cancellation policy before you pay them anything. Satisfy yourself as to who you are dealing with. We recommend that you take out your own travel insurance.
4. We do not vet or endorse Operators, and a listing is not a recommendation
This section matters, so it is written without hedging.
We do not verify Operators. We do not check an Operator’s licence against any register. We do not inspect their insurance, their financial standing, their solvency, their safety record, their vehicles, their guides, their permits or their compliance with any law. We do not audit their listings, their prices or their availability.
An Operator supplies a licence number when registering, and we store it, but we do not confirm that it is genuine, current, or held by that company. An account may be reviewed by an administrator before a profile appears on the site. That review is an editorial check that a profile is complete and plausible, and nothing more. It is not a check of licensing, insurance, competence or good standing.
Some profiles may carry a “Verified” marker. That marker is an internal administrative flag set by hand. It does not mean that we have verified the company’s licence, insurance, credentials or conduct, and no Traveller should treat it as if it did. [NOTE FOR THE OWNER: the site’s code lets an administrator switch this flag on and off with no check behind it. Before launch, either define in writing what has to be true for a company to carry it and say so on the page, or remove the badge. A “Verified” badge that means nothing is a liability, and this paragraph is the only thing currently limiting it.]
The presence of a company or a safari on this site is therefore not an endorsement, recommendation, approval, accreditation, certification or warranty of any kind by us. The order in which listings appear, and any “featured” placement, are editorial or commercial arrangements and carry no implication about quality or reliability.
We give no warranty, express or implied, about any Operator, about any listing, or about any trip. Choosing an Operator is your decision and your risk, and you should carry out your own checks.
5. Listing information is the Operator’s, and we do not warrant it
Every itinerary, price, inclusion, exclusion, date, duration, photograph, description and claim in a listing is written and published by the Operator. We do not write it, and we do not check it.
Prices and availability shown on this site are indicative and can be out of date, wrong, or withdrawn. Nothing on this site is an offer capable of acceptance, and nothing on this site binds an Operator to a price or a departure. The only figure that means anything is the one the Operator quotes you directly.
We may, but are not obliged to, correct, edit, reformat or remove listing content. Doing so does not make us responsible for it.
6. Enquiries
When you send an enquiry, we pass it to the Operator by email and keep a copy. We do not guarantee that an Operator will reply, that they will reply within any period, that they will honour any price shown, or that the trip is available. Non-delivery of an email — for any reason, including an Operator’s mailbox being full, wrong or unmonitored — is not something we are liable for.
Send enquiries in good faith. Do not use the enquiry forms to send advertising, bulk messages, abuse, or anything unlawful. How enquiry information is handled is set out in the Privacy Policy.
7. Terms for Tour Operators
This section applies to you if you hold an Operator account. It is in addition to the rest of these terms.
7.1 Eligibility and your warranties
By registering an account and by publishing any Listing, you represent and warrant to us, on a continuing basis, that:
- you are a tour company established and operating in Uganda, and the person registering is authorised to bind you;
- you hold every licence, permit, registration, membership and authorisation required by law for you to trade and to sell and operate the trips you list, that all of them are current and in good standing, and that the licence number you supplied to us is genuine and is yours;
- you hold, and will maintain, the insurance a company in your business is required or reasonably expected to hold, including public liability and passenger liability cover;
- you comply, and will continue to comply, with all laws applicable to your business, including tourism, transport, wildlife, tax, consumer, anti-bribery and data protection law;
- every statement in every Listing you publish — itinerary, price, inclusion, exclusion, availability, duration, permit and any claim about your company — is accurate, current and not misleading;
- you will honour the trips you sell, and you will deal fairly and promptly with Travellers who contact you through this site.
You will tell us without delay if any of the above stops being true — in particular if a licence or an insurance policy lapses, is suspended or is withdrawn.
7.2 You are solely responsible for what you sell and what you publish
You alone are responsible for your Listings and for the trips you sell through enquiries generated by them. That includes their accuracy, their pricing, their availability, the permits they require, the suppliers you use, the safety of what you run, your contract with the Traveller, your cancellation and refund policy, the handling of any money you take, and your compliance with the law.
We have no responsibility for any of it, and you will not represent to a Traveller or to anyone else that we do. You must not describe yourself as our agent, partner, or as being endorsed, approved, verified or accredited by us, and you must not present the site as taking bookings, holding money or standing behind your trips.
7.3 Content you upload: licence and warranty
You keep ownership of the text, photographs, logos and other material you upload. By uploading it, you grant us a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, store, reproduce, resize, crop, adapt for display, publish, distribute and display that material on this site and in connection with promoting the site and your listings on it, including in search results, social media posts, newsletters and other marketing for the site.
The licence lasts while your content is on the site and for a reasonable period afterwards to the extent needed for caches, backups, archived copies and material already distributed.
You warrant that you own every photograph and every piece of text you upload, or that you hold all rights and licences necessary to grant us the licence above, and that the material does not infringe anyone’s copyright, trade mark, moral rights, privacy or other rights. This matters in practice: photographs are frequently uploaded that were taken by someone else, taken from another company’s website, or licensed for a use that does not cover publication here. Do not upload a photograph unless you are certain you are entitled to. Where a photograph shows an identifiable person, you warrant that you have the consent needed to publish it.
We may remove any content on notice of an infringement claim, and we may do so without waiting for the claim to be resolved.
7.4 Traveller information
Enquiries we pass to you contain a Traveller’s personal information. You must use it only to respond to that enquiry and to deal with the trip it concerns; you must keep it secure; you must comply with applicable data protection law in handling it, including Uganda’s Personal Data Protection and Privacy Act, 2019; and you must not add a Traveller to a marketing list, sell their details, or pass them to anyone else without that Traveller’s consent. If a Traveller asks you to delete their information, that is your obligation to meet, not ours.
7.5 Indemnity
You will indemnify us and keep us indemnified against all claims, demands, proceedings, losses, damages, liabilities, fines, penalties, costs and expenses (including reasonable legal costs) that we suffer or incur arising out of or in connection with:
- any Listing or other content you publish or upload, including any claim that it infringes a third party’s rights or is inaccurate or misleading;
- any trip or service you sell, arrange or operate, and any act, omission, delay, cancellation, injury, loss or damage arising from it;
- your breach of these terms or of any warranty in them;
- your breach of any law, including any failure to hold a required licence, permit or insurance;
- any dispute between you and a Traveller, including any claim about payment, refund or performance; and
- your handling of personal information received through this site.
7.6 Suspension and removal
We may remove, unpublish, edit or refuse any Listing, and suspend or terminate any Operator account, at any time and at our discretion. We will normally give a reason and, where it is reasonable to do so, a chance to put the problem right, but we are not obliged to. Reasons include, without limitation:
- inaccurate, misleading, outdated or duplicated listing content, or misleading pricing;
- content you were not entitled to upload, or a credible infringement complaint;
- a lapsed, suspended, withdrawn or false licence, registration or insurance;
- failure to respond to enquiries, or a pattern of complaints from Travellers;
- conduct that is unlawful, fraudulent, abusive, discriminatory or unsafe, or that harms Travellers or the reputation of the site;
- attempts to circumvent, spam or manipulate the site, its rankings or its enquiry system;
- breach of these terms; or
- a change to the site, or a decision to stop operating it.
No compensation of any kind is payable for removing a Listing, suspending or closing an account, or discontinuing the site, and no refund of any fee is due, whether or not a reason is given. We are not liable for any loss of enquiries, bookings, revenue, goodwill or opportunity arising from it.
On termination, your right to use the site ends. We may keep copies of your content and account records as required for our records, for legal reasons, and in backups.
7.7 Fees
[TO BE COMPLETED: whether listing on the site is free, and whether the owner intends to charge a listing fee, a subscription, a featured-placement fee or a commission in future. The site presently takes no payment of any kind and its own footer tells operators that listing is free. If that is to change, this section must set out the charges, how they are billed, and how notice of a change is given — and the footer wording must change with it.]
8. Acceptable use
This applies to everyone. You must not:
- use the site for anything unlawful, fraudulent or harmful, or to impersonate anyone;
- scrape, crawl, harvest, spider, index or systematically extract content from the site, whether by software, bot, script or manual copying, except that a general-purpose search engine may crawl the site in accordance with our robots file;
- copy, republish, resell or redistribute the site’s listings, guides, descriptions, images or data, in whole or in substantial part, or use them to build, train or populate a competing directory, database, dataset or model;
- collect email addresses, phone numbers or other contact details from the site, or use the site or its enquiry forms to send unsolicited marketing;
- submit false enquiries, or enquiries you do not intend to follow up;
- attempt to gain unauthorised access to any part of the site, any account or any server; interfere with its operation; or introduce malicious code;
- place a load on the site that is disproportionate or that degrades it for others; or
- circumvent, disable or interfere with any security or rate-limiting measure.
We may block access and take any other step available to us where these rules are broken.
9. Our own content
The site itself — its design, layout, code, structure, its destination and park guides, its planning articles, its editorial descriptions, and the selection and arrangement of the listings it contains — is ours or is used by us under licence, and is protected by copyright and other rights. Operator-supplied listing content belongs to the relevant Operator.
You may read the site and share links to it. You may quote a short extract with clear attribution and a link. Beyond that, you may not copy, reproduce, adapt, republish or exploit any part of the site without our written permission. Nothing on the site transfers any right in our name, logo or branding.
10. The site itself
We try to keep the site accurate, current and available, but we do not promise that it will be. The site is provided “as is” and “as available”. To the fullest extent permitted by law we exclude all warranties, conditions and representations, express or implied, including as to accuracy, completeness, currency, merchantability, fitness for a particular purpose and non-infringement.
We may change, suspend, restrict or withdraw the site, or any part of it, at any time and without notice.
The site links to Operators’ own websites and to other external sites. We do not control them, we do not endorse them, and we are not responsible for their content, their accuracy, their security or their privacy practices.
11. Limitation of liability
Nothing in these terms limits or excludes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. Subject to that:
We are not liable for the acts or omissions of any Operator. In particular, and without limitation, we are not liable for:
- any trip that is cancelled, curtailed, changed, delayed, overbooked or not provided;
- any trip that is provided badly, unsafely or differently from how it was described;
- any injury, illness, death, loss of or damage to property, or other harm suffered before, during or after a trip;
- any misrepresentation by an Operator, any error in a Listing, and any difference between a listed price and the price you are charged;
- the insolvency, bankruptcy, liquidation, closure or disappearance of an Operator, and any loss of money paid to them, including deposits, balances and permit fees;
- any failure by an Operator to hold or to maintain a required licence, permit or insurance;
- any refund an Operator owes you and does not pay; or
- any dispute between a Traveller and an Operator.
Money paid to an Operator is paid to that Operator. We never receive it, never hold it, and cannot recover it, refund it or guarantee it.
We are also not liable for any loss of profit, revenue, business, contracts, enquiries, bookings, goodwill, anticipated savings or data, or for any indirect or consequential loss, however caused.
[TO BE COMPLETED: a financial cap on our total liability. A platform that takes no money from Travellers has no natural cap to point at, so this has to be set deliberately — commonly a fixed sum, or for Operators the fees they have paid in the preceding twelve months. A lawyer should set the figure and confirm it is enforceable in the chosen jurisdiction.]
12. Privacy
How we handle personal information is set out in the Privacy Policy, which forms part of these terms.
13. Changes to these terms
We may change these terms. The current version is always the one on this page, and the date at the top shows when it last changed. For Operators, we will give reasonable notice of a material change by email or through the operator dashboard; continuing to use the site after that is acceptance of the change. If you do not accept a change, stop using the site and, if you are an Operator, close your account.
14. General
If any provision of these terms is found to be unenforceable, the rest continue to apply. A delay in enforcing a term is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours if the site changes hands. There is no partnership, joint venture, employment or agency between us and any Operator or Traveller. Nobody who is not a party to these terms may enforce them.
15. Governing law and jurisdiction
[TO BE COMPLETED: the governing law of these terms and the courts that have jurisdiction over disputes arising from them. This is a decision for the owner and their lawyer — it depends on where the operating entity is established and who the site is intended to serve — and it has deliberately not been guessed here. A wrong jurisdiction clause is worse than none, because it can be relied upon and then fail.]
